Broadcasting agency of Montenegro

The Parliament of Montenegro adopts a Decision on Appointment of the members of the Council of the Agency for Electronic Media (Official Gazette of Montenegro, No. 74/10).

The Council of the Agency for Electronic Media has five members, one whom is elected as the Chairman of the Council. Candidates for the Council members are nominated by:  

- commercial broadcaster associations, five-year term of office.
- University of Montenegro, five-year term of office;
- non-governmental organisations dealing with human rights and freedoms, five-year term of office;
- Montenegrin PEN Centre, four-year term of office;
- non-governmental organisations dealing with the media, four-year term of office.

The inaugural meeting of the Council of the Agency for Electronic Media was held on 27 December 2010. 

In compliance with the Electronic Media Law (Official Gazette of Montenegro, No. 46/10), the Agency Council:
- adopts the Agency’s Articles of Association;
- drafts AVM service sector Development Programme;
- gives opinion on the background paper for developing a plan for the use of the radio-frequency band, in the section designated for terrestrial broadcasting, developed by the regulatory body for electronic communications;
- approves draft radio frequency allocation plan, as regards terrestrial broadcasting;
- invites public tenders for granting the right to AVM service provision;
- decides on granting the right to AVM service provision;
- approves temporary or permanent assignment, rental or otherwise transferral of AVM service provision licence;
- adopts the rules on the amount, the method of calculation and payment of a registration fee and licence fees for provision of AVM services;
- adopts rules on programme standards for AVM service provision;
- adopts rules on requirements regarding minimum proportions reserved for European audiovisual works and independent productions, in line with European standards;
- adopts rules determining requirements and proportions reserved for audiovisual commercial communication, in line with European standards;
- adopts rules governing the method of taking measures against AVM service providers and taking decisions as per complaints regarding their operation;
- decides as per appeals against the Agency’s first instance decisions;
- takes measures for temporary restrictions to the freedom of reception and retransmission of AVM services from other countries in accordance with Article 6 of this Law;
- reports to the European Commission in accordance with this Law and the ensuing implementing legislation;
- adopts Council’s Rules of Procedure;
- elects the Chairman from among the Council members;
- appoints and dismisses the Agency Director;
- adopts the general legal act on internal organisation and job systematisation;
- adopts work plans, activity reports and periodic and annual accounts of the Agency;
- adopts the financial plan for the coming year and the financial statements for the previous year;
- hires an independent certified auditor to audit final accounts of the Agency;
- adopts other rules for implementing this Law;
- performs other tasks, as per the Law and the Agency’s Articles of Association.
